An arrest is confusing for the person in custody and frightening for their family. Understanding how arrest and booking work in Vista helps you know what to expect and when you can act to get your loved one released.
The arrest
In Vista, arrests are usually made by the San Diego County Sheriff's Department, which provides police services to the city, or by the California Highway Patrol on local freeways. The officer may read the Miranda rights before any questioning. Anyone arrested has the right to stay silent and to ask for a lawyer.
Transport to jail
Adult men and women arrested in North County are usually taken to the Vista Detention Facility. Some people are later moved to other county jails such as San Diego Central Jail or Las Colinas.
The booking process
Booking is the official record of the arrest. It typically includes:
- Recording personal information and the charges
- Fingerprints and a booking photo (mugshot)
- A warrant and criminal records check
- A medical and safety screening
- Inventory and storage of personal property
Booking can take a few hours or longer on busy nights. During this time families can use our free inmate information service to locate the person and get the booking number.
Phone calls
California law (Penal Code 851.5) gives an arrested person the right to at least three free phone calls shortly after booking — for example to a family member, a bail bond agent and an attorney.
Talk to a criminal defense attorney early
What is said in the first hours after an arrest can matter a great deal. Speaking with an experienced San Diego criminal attorney as early as possible helps protect your rights, prepare for arraignment and, in some cases, argue for lower bail or release.
Bail and release
Once booking is complete and bail is set, a bond can be posted. Learn the full steps in how the bail process in Vista works. If a person may have an outstanding warrant, our free warrant search can help.
Arraignment
If the person stays in custody, California generally requires arraignment within 48 hours, not counting weekends and holidays. In North County, arraignments are usually held at the North County Regional Center courthouse in Vista.
Vista Bail Bonds is located at 1463 W Vista Way, Suite B — minutes from the jail. Call 760-870-7777 24/7 for help.
